This Agreement is a legal document, which sets out your rights and obligations, and those of Bettervouchers ("we", "us" or "Bettervouchers"), in relation to this site and the services offered by us through it (the "Bettervouchers Service"). Please read and understand it before registering for a Bettervouchers account. By registering, you accept that you are entering into a contract with us on the terms of this Agreement. You should be aware that this Agreement may change from time to time in accordance with Clause 16 below.

2. Bettervouchers Service

Bettervouchers allows Account Holders to find voucher codes and to click-through to online retailers (the sellers of the goods) to purchase products.

All information provided by you to register for a Bettervouchers Account must be accurate, such as name and address. You must ensure to consistently keep this information up to date on your Account. Please see our Privacy Policy for more information on how we look after the personal information you provide to us.
The email address you provide to us will be our main method of contact, and we will use this to send you important messages that may concern your account. Please make sure you have access to this email, and if you have changed email then please update this on your Account.

4. Intellectual Property

If you upload any material onto your Bettervouchers Account, you grant us licence to use this material in any way we deem fit. You also grant other Account Holders the right to view this material.

5. Privacy policy

Please read our Privacy Policy, as this is also part of your Agreement in creating an Account with us.

6. Our Role

We do not supply or sell any of the products available on our website, and as such we do not endorse these or have any obligation to ensure the correct conduct of the retailers selling them. We have no responsibility for how the products arrive to you, what condition they are in, the legality or the safety of these products. We guarantee to check each voucher code manually before adding them it to Bettervouchers.com and filter out any expired vouchers, although we cannot guarantee that all vouchers will be functional when used by Account Holders.

7. Misuse

We may suspend an Account at any time we find reasonable. Reasons for Account closure may include:

  1. breaching these Terms and Conditions
  2. providing payment methods you are not authorised to use.
  3. exploiting retailer’s offers
  4. using offensive language, abusing other users or causing distress.
  5. attacking or attempting to interfere with Bettervouchers property; for example using a computer virus with the intention of accessing our Accounts.
  6. advertising any other services
  7. breaching other Account Holder’s rights (for example, privacy rights)
  8. giving purposefully negative feedback to a retailer for no acceptable reason.
You must acknowledge that you may be asked to remove material from your Account which we deem to be in breach of these conditions.

8. Third Party Contact

If we are contacted by any third party (for example, a retailer you have purchased goods from) about anything in relation to your Account, you must agree to respond to any of our queries quickly and accurately, and you must provide us with information you believe to be accurate.

9. Additional services

If we, or partners we are affiliated with, offer any new services through Bettervouchers your use of these may be governed by extra terms and conditions which you must agree to. You will be shown these additional terms and conditions by us as quickly as possible, and should agree to these in a timely manner. If you fail to comply with these then you will be in breach of these original Terms and Conditions.

10. Using the Bettervouchers Service

Bettervouchers may occasionally be inaccessible for you due to technical reasons. We will endeavour to resolve these issues as soon as possible, and will attempt to give you 30 days notice before withdrawing or modifying any part of our service, unless we are required to do this sooner for any reason that would adversely affect us.
If we ever need to work on the website in a way that will make it difficult to access or unavailable, we will inform you of this and attempt to make the duration as short as possible. We can never promise access to our service or content, although we will always try to make it available. There may be times where, for reasons such as security, we might ask you to change some of the information you associate with access to your Account like a password. We will never require your password or other confidential information from you other than for use on the www.bettervouchers.com website, and you are entirely responsible for keeping your Account and login details safe.

11. Liability

  1. We will, at all times, attempt to ensure that we provide a service that meets expectations, but we do not guarantee that Bettervouchers will consistently meet your requirements.
  2. Bettervouchers will be liable as outlined in this Agreement but will not have any other liability (such as breach of statutory duty or negligence).
  3. This Agreement does not, in any way, exclude our liability for any personal injury or death caused by our negligence.
  4. Subject always to sub-Clause e. below, Bettervouchers shall be liable for direct loss or damage only, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise, and whether caused by its act or omission or that of its employees, agents or subcontractors. Bettervouchers's aggregate liability during any successive period of twelve months, the first of which shall be deemed to begin on the date when you obtain your Account, shall be limited to the greater of (a) £5 (five pounds sterling), or (b) the amount of the then-current Premium Features Retention Fee (whether or not it is payable by you), in respect of that twelve-month period.
  5. We will not be liable to you or anyone else, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise:
    1. for any loss of revenue, business, anticipated savings or profits, or
    2. for any indirect, special or consequential loss, damage, costs or other claims, howsoever caused or arising, whether through non-supply or late supply of the Bettervouchers Service or other non-performance of this Agreement or otherwise.
  6. Except as expressly stated elsewhere in this Agreement, all representations, warranties, conditions and other terms, whether express or implied (by common law, statute, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by law.
  7. For the avoidance of doubt, Bettervouchers will not have liability to you or any other person in respect of material contributed by Account Holders, transactions (or non-transactions) with retailers, or any activity or communication relating to such material or transactions.
  8. The provisions of this Clause 12 shall survive the termination or expiry of this Agreement

12. Indemnity

You agree upon demand to indemnify Bettervouchers against and to be wholly responsible for all liabilities, claims and expenses that may arise out of or in connection with (a) any breach of this Agreement by you or through your Account, or (b) any transaction with a retailer.

13. Assignment

We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement, but will not do so in such a way as to reduce any guarantees you are given under this Agreement. You may not without the written consent of Bettervouchers assign or dispose of this Agreement, nor subcontract any of your rights and obligations under it.

14. Entire Agreement

These Terms and Conditions contain your entire agreement with us in regards to the Bettervouchers service. It will replace any earlier understandings or agreements between you and the Bettervouchers service, and we believe these to be fair.

15. Changes to this Agreement

We may change these Terms and Conditions at any time, and will post the most recent version on the Bettervouchers website. The most recent version of these Terms and Conditions will be the active Agreement between you and Bettervouchers and will take effect:

  1. commencing no less than thirty days after the date of posting (or such later date as we indicate in the relevant posting), if any of the changes is to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when the new version of the Agreement is to take effect, and from that date you must cease to use the Bettervouchers Service; or
  2. immediately upon the date of posting (or such later date as we indicate in the relevant posting), if the changes are not to operative provisions, or not capable of adversely affecting you - examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in this Agreement.

16. General

In the event that any term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. You and Bettervouchers are independent contractors, and no agency, partnership, joint venture or employee-employer relationship is intended or created by this Agreement. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. Any disagreements we will settle by binding informal arbitration.

17. Law

You and we each submit to the non-exclusive jurisdiction of the English courts in relation to disputes arising in connection with this Agreement.
